In August 2005, The Lanier Law Firm proved to a jury in Brazoria County, Texas, that Merck & Co., the manufacturer of VIOXX, was liable for the death of the plaintiff Robert Ernst. The jury found that Merck failed to warn doctors of the dangers of VIOXX, and that Merck's negligence caused the death of Robert Ernst, a physically fit triathlete who died of a sudden heart attack.
