What Is the Timeline of a Mesothelioma Case?

One of the first things we have to look at is how long ago was the diagnosis. We have what’s called the statute of limitations, and the statute of limitations can be different in almost every state. For example, in Texas it’s 2 years, in Louisiana it’s 1 year, in other states it’s 4 years. The statute of limitation is the time within which we have to file the lawsuit or else it’s forever barred. In order to determine when to file the lawsuit we need to know when the date of diagnosis was or in the case of a death, the date of death, because there could be a new statute of limitations for the death claim. Depending on this jurisdiction, and frequently when we get approached by clients, they may have been exposed in more than one state. And so we’d have to take a look at all the possibilities and determine where we’re going to file the case, when it has to be filed, we’d be governed by that state’s statute of limitations.
