Understanding Liability for a Drunk Driving Accident

It is against the law to drive while under the influence of drugs or alcohol in the state of Texas. A driver is presumed drunk if their blood alcohol concentration is equal to or greater than .08 percent. A driver can also be considered drunk if their blood alcohol concentration is above 0 and they lack the mental or physical ability to drive safely.
