Am I Suing a Company, the Military, or the Government During a Lawsuit?

Every case that comes to us is unique in some way. Yes, the person has mesothelioma. Yes, it’s a terrible diagnosis and yes, the prognosis is not good. It’s really the person’s exposure that drives who to file the claims against, whether it’s an assaulted company, in litigation, a bankruptcy trust that’s out there established to compensate people who were exposed to those products or anywhere in between and so our goal here at the firm is to identify who’s responsible for those exposures. We received calls from military servicemen who served our country, and they wanna know, are you going to be suing the navy? And the answer to that is, under most circumstances, almost universally, the military cannot be sued. However, on those military ships where they served, there are products throughout the ships that were manufactured by private companies and distributed by private companies. So those are certainly viable cases, and to the extent a client has a loyalty to the to the military that is typically not who the target of the litigation is. The litigation is targeted towards the asbestos manufacturers, much like any other cases. Similarly, we have clients that sometimes say I worked for XYZ company for 50 years, and I don’t want to sue them, you know, they were good to me. Similarly, if that’s the client’s wish, although there may be a viable case against the employer, if that’s the client’s wish, they control the decision and in those situations we will find similarly manufacturers, distributors of asbestos-containing products within the facility that caused the damage. And the reality is that these are the clients’ cases, not our cases, and the clients hire us to help them make the best decisions for them and their families.
