Will All Mesothelioma Cases Go to Trial?

A common question the clients have for us is whether or not their case is actually gonna go to trial or not, and the answer to that is, you know, the statistics say that 95% of all civil cases settled out of court, and I would say that’s probably pretty accurate for mesothelioma cases too. But it is also inevitably driven by the client’s desires, the client’s objectives and goals in the case. We try to settle all the claims we can outside of court. Obviously that’s in the client’s best interest, and we do everything possible to settle claims against defendants out of court, but if a case, there are corporations who just absolutely refuse to accept responsibility for their wrongful actions. With the client’s consent, we stand ready, willing and able to take those corporations to court and convince them why they should have come around and settled the case. Most of our clients do come to the Lanier Law Firm with the goal of avoiding trial if they can. And so we keep that in mind as we proceed with the case and it’s always the client’s decision how far to take their claims and whether they want to take the case to trial or not. We understand how important it is to most clients to try to settle their cases without having to go through a trial.
