In this New York case, Joseph Skrzynski successfully sued Ford Motor Company after developing peritoneal mesothelioma from asbestos exposure while working at a Ford dealership. The court’s majority ruled that there was sufficient evidence to prove Ford’s asbestos-containing brake products caused his mesothelioma.

Evidence Linked Ford Brake Products to Secondary Asbestos Exposure

The evidence showed that Ford’s brakes contained chrysotile asbestos fibers, and when mechanics worked on these brakes, dangerous asbestos dust was released into the air. Even though Mr. Skrzynski was a parts driver and clerk rather than a mechanic, he spent significant time in the garage where brake work was performed, breathing in this toxic dust during many brake jobs over his five-year employment.

Expert witnesses testified that chrysotile asbestos from automotive brake products can cause mesothelioma generally, and that Mr. Skrzynski’s specific level of exposure was sufficient to cause his mesothelioma.

The court thus affirmed the jury’s verdict in favor of Mr. Skrzynski, finding that Ford failed to adequately warn workers about the dangers of asbestos exposure from their brake products, making this failure a substantial contributing factor in causing Mr. Skrzynski’s mesothelioma.
