Can I Sue A Bankrupt Asbestos Company?

Over the course of the last 2 or 3 decades, many asbestos companies have filed bankruptcy. Because of those bankruptcies and the bankruptcy laws in the United States, you cannot sue, a person cannot sue a company who has filed bankruptcy. But fortunately, all those companies were required to set up trusts for the payment of both present and future mesothelioma asbestos-related cases. And so it is a claim process, you actually file rather than suing the companies, you file a claim with the trust that was established as part of that company’s bankruptcy. And then those have different, every trust is different in terms of the requirements, the proof requirements, but eventually, settlements are made with those trusts.
