Personal Background

Kyle Schnitzer is a senior attorney in The Lanier Law Firm’s Houston office. As a member of the Issues and Appeals section, Kyle’s work protects clients’ cases both before and after trial to maximize their recoveries and vindicate their rights. Kyle joined the Lanier Law Firm in 2025 after twelve years at one of the largest personal injury firms in Texas where, as the senior briefing attorney, he led a team of briefing lawyers and supported all phases of litigation, from pre-trial strategy and venue selection through summary judgment practice, trial, and appeals.

Since joining the firm, Kyle has served as a lead briefing attorney on In re AT&T Inc. Customer Data Security Breach Litigation — one of the largest data breach settlements in American history — where he developed a novel legal theory under the Satellite Home Viewer Extension and Reauthorization Act of 2010 that was incorporated into the filed complaint, and co-authored the briefing that formed the foundation for Mark Lanier’s arguments at the six-hour final approval hearing before Judge Ada E. Brown in January 2026. He has also collaborated with Of Counsel Harvey Brown, a former First Court of Appeals Justice, on the historic rewrite of Texas Rule 166a, contributing comments and suggestions to the Texas Supreme Court Advisory Committee’s draft ahead of the rule’s March 2026 effective date.

A native Texan, Kyle lives in Houston with his wife and their four young children.

  • In re AT&T Inc. Customer Data Security Breach Litigation, MDL No. 3:24-md-03114-E (N.D. Tex.) (one of the largest data breach class action settlements in American history; $177 million settlement fund affecting approximately 100 million customers; Mark Lanier serves as AT&T 1 Class Counsel; Kyle served as a lead briefing attorney, developed a novel statutory theory of liability incorporated into the filed complaint, and co-authored the settlement approval briefing presented at a six-hour final approval hearing in January 2026; decision pending).
  • Frederking v. Cincinnati Ins. Co., 929 F.3d 195 (5th Cir. 2019) (emphatically reversing a summary judgment rendered in favor of an insurer that had argued wrecks caused by drunk drivers were not covered “accidents.” The appellate court’s opinion began: “Only an insurance company could come up with the policy interpretation advanced here.”)
  • Lowe v. Watson, No. 01-20-00251-CV, 2020 WL 7349506 (Tex. App.—Houston [1st Dist.] 2020, no pet.) (mem. op.) (reversing summary judgment for insurer that had argued the plaintiff’s release of his family members’ claims after a wreck also released his own claims)
  • Trujillo v. Werner Enterprises, Inc., No. 14-20-00354-CV, 2021 WL 5934724 (Tex. App.—Houston [14th Dist.] 2021, no pet.) (mem. op.) (reversing summary judgment for trucking company due to fact issues regarding the company’s status as a broker or motor carrier for the load at issue)
