Personal Injury Litigation
Personal injury litigation is as simple as someone having a case because they’ve been injured or they’ve had a family member that’s been killed, and the terms we use in law is negligence, but that’s just a fancy way of saying reasonableness. So when someone acts in an unreasonable fashion and causes someone to get hurt, you may have a claim that we can prosecute for you. Unfortunately, there are almost innumerable ways that people receive injuries or someone’s killed in some fashion, and you just need a law firm to look through that and make sure that it fits into the law, and you have a valid claim that you can make in court and that’s where we take it and run with it. Product liability cases, the defendant that you’re going after, the defendant that you’re suing was actually probably not at the scene. And so a lot of times when somebody gets hurt, you will realize that they shouldn’t have gotten hurt, that something went wrong, but it’s not because of somebody at the scene doing something wrong. Instead, it’s something that was being used that wasn’t working right. A lot of times it seems like it’s the injuries where you just feel like in your gut it shouldn’t have happened. It gives you the clue that maybe something really is wrong there and sometimes, I don’t know how often you’ve run into this, but sometimes it seemed like the experts that you hire, sometimes you hire an expert to go out and look at something, and they come back and say, “I can’t figure this out,” and you end up having to go to maybe a second expert because you know it shouldn’t have happened. You know it shouldn’t have happened. In almost every case we handle, we wind up with one or more experts. There was a case that I had an expert go out and look at, and we had no idea why this young boy ended up with a brain injury. He was in the backseat of a car and they got rear-ended twice. He got hit from behind and then the car did a 180 and hit the car in front of it again from the back, and the young child ended up with a brain injury. So I sent out one expert to look at it and he says, “Got no idea what happened to this kid.” I mean, we knew he had a cut on his head, but he was buckled in. Nobody knew what happened. He suggested maybe another expert, but the neat thing about our firm was I knew from information that our firm had that seat backs were a potential problem in these cars, and so we had a seat back expert that we had to go out and look at it, and he said, “Yep, that’s what did it. The seat collapsed and the front passenger went back and his head struck this child in the back,” and nobody had thought of that. This job litigation, high-stakes litigation is a stressful profession. Working here is made much more or less so by the quality of people that we get to work with and how they treat each other. The greatest good that we may do is actually on a society level at making this world a safer place, and those are the types of things that I think that, as attorneys, we can probably have the biggest impact, one that is one that won’t be felt, won’t necessarily be seen in a way that people will know it. But whether they know it or not, they are safer because of the lawsuits we bring.
