With or Without the Product: How We Get Talcum Powder Lawsuit Evidence Either Way

So when you start investigating it, you need to figure out specifically what products they used because certain talc products may not have contained asbestos, for all we know, depending on what region the talc was sourced from and maybe depending on some other factors.

And so you got to figure out what the product is. You gotta see if the client still has any of the product. Some people will have old products stuck in their cabinet from many years ago, or maybe they just stocked up a long time ago and so they just have a high supply of these products. And if they have that product, what we want to do is we want to provide it to an expert to test it to see if it contains asbestos.

Also, let’s say we don’t have the product. We just need to get the product name either way and we’ll have the witness testify about all their use of the talcum powder product or whatever talc product they used. And eventually, we will talk with our experts and see what they know about that product. We’ll try and get documents and evidence from the manufacturer of that product, from their talc supplier, and do our best to figure out where the talc was sourced from. And quite often the talc is sourced from mines that are contaminated with asbestos.
