How Are Lawsuits Against Bankrupt Asbestos Companies Handled?
So, we’re talking about bankruptcy claims and claims against companies that are still in business. Those are two separate claims processes but are handled simultaneously by our firm. So, when we receive a client who has suffered mesothelioma as a result of asbestos exposure, we evaluate all the potential sources of exposure, and some of those sources of exposure have filed bankruptcy. Some of them have not filed bankruptcy. So in the process of handling a client’s claim, we simultaneously pursue both the bankruptcy claims and what we call the viable claims or the claims against existing companies. And the claims against the existing companies involve litigation, the filing of lawsuits and and potentially trials if the case is not, is not resolved by virtue of the settlement. Conversely, although they’re being handled simultaneously, the bankruptcy claims are not a lawsuit. They are claims with the various trust fund claims that have been set up by bankrupt companies.
