How Does the Federal Employers Liability Act Protect Railroad Workers?
The Federal Employers’ Liability Act is a special act that was passed by the United States Congress in 1908. The Act provides a means for railroad workers who are injured on the job due to the negligence of their employer railroad to recover for their injuries. If the railroad’s negligence caused the railroad workers’ injury in any part, even the slightest degree, the worker is able to recover. Having said that though, the worker does need to prove negligence on the part of the railroad. Again, the burden of proof or the amount of evidence that’s required for the worker to recover is if the railroad’s negligence caused the injury in any part, even the slightest degree, the worker can recover.
