Who Is Liable for Asbestos-Related Illnesses in Utah?

If you have contracted mesothelioma or another asbestos-related illness, the companies that exposed you to asbestos may be held responsible under the strict liability doctrine or negligence.

Strict Liability

Companies can be held strictly liable for products that cause harm due to an inherent danger, a manufacturing or design defect, or the failure to warn of the risks. The following companies are among those that may be held strictly liable: 

  • Asbestos mining companies
  • Asbestos product manufacturers
  • Asbestos product distributors
  • Asbestos product retailers
  • Agents of asbestos companies
  • Importers of asbestos products

Negligence

The same parties can also be held liable under negligence in mesothelioma claims. In addition, building contractors, building owners, and some employers may be held liable for asbestos exposure due to negligence. 

Negligence occurs when a company or individual owes a duty of care but breaches that duty, resulting in harm.

The Utah Department of Environmental Quality requires contractors and building owners to have inspections performed by state-certified asbestos inspectors before building renovations, demolitions, and asbestos removal. They must maintain a copy of this inspection report on the premises.

Asbestos

Strict liability applies whether or not there was negligence and applies to everyone in the supply chain, even if they were unaware of the product or its dangers. According to Case Dam:

“In 2017, the Utah Supreme Court issued an opinion in Bylsma v. R.C. Willey, which dispensed with the idea of an ‘innocent seller’ and held that a seller of a defective product is liable under the doctrine of strict liability even if the seller has exercised all possible care in the preparation and sale of his product.”

This rule applies to commercial building contractors and owners of residential structures such as condominiums and apartment complexes with more than four units. 

When contractors perform renovations, demolitions, or asbestos abatement without the required inspections, they breach their duty of care. They may be liable if asbestos fibers are released and cause someone to consequently develop mesothelioma.

Utahns with Mesothelioma May Be Eligible for Substantial Compensation

Compensation for mesothelioma and other asbestos-related illnesses is available through multiple types of claims, and most of our clients qualify to file more than one claim.

Mesothelioma Lawsuits

The types of damages available in a mesothelioma lawsuit include economic, non-economic, and punitive damages. Economic damages are monetary losses, such as medical expenses and lost wages. Non-economic damages are compensation for subjective losses, such as pain and suffering. There are no limits on the amount of economic or non-economic damages you can receive.

Punitive damages are not available in every case but are often available in mesothelioma cases. According to Utah personal injury law, your case qualifies for a punitive damage award if you can prove that the plaintiff engaged in any of the following:

  • Willful and malicious conduct
  • Intentionally fraudulent conduct
  • Conduct that displays a conscious, reckless disregard for the rights and safety of others

If you win punitive damages in Utah, the first $50,000 of your award is paid to you. Any amount exceeding $50,000 is divided between you and the state.

Asbestos Trust Funds

The asbestos companies actively concealed the dangers of asbestos for nearly half a century. By the late 1970s, the general public had become aware of its dangers, and lawsuits against asbestos companies abounded due to the significant numbers of people who had developed mesothelioma and other asbestos-related diseases.

The number of asbestos-exposure victims was so significant that many companies became overwhelmed and declared bankruptcy. Bankruptcy protects companies from being sued. However, Section 524(g) of the U.S. Chapter 11 Bankruptcy Code requires such companies to establish asbestos trust funds.

These trust funds compensate present and future asbestos-exposure victims. If you were exposed to asbestos by one of the bankrupt companies, you may be able to file a claim against that company’s trust fund. These are generally companies that supplied asbestos to employers. 

In most cases, these companies are located outside the state. The following Utah companies have filed for bankruptcy and established trust funds:

  • Hercules Inc.
  • Owens-Corning Fiberglass Corporation

Workers’ Compensation for Mesothelioma

If you were exposed to asbestos in the workplace, your employer may be liable if you develop a related illness. However, as an employee, workers’ compensation most likely covers you. Workers’ compensation protects employers from lawsuits while providing employees partial wage replacement and medical care.

In Utah, this applies to workplace exposure cases that occurred after 1941. If you were exposed to asbestos through more than one employer, the last one that employed you for at least 12 months is generally liable. 

There is an exception if employment lasted less than 12 months or your asbestos exposure at the last employer was insignificant. In these cases, all involved employers are liable, with each employer’s share based on its contribution to your illness.

Workers’ compensation benefits in Utah include the following:

  • Weekly compensation (if you were still working and had to quit because of your diagnosis) – 66 and two-thirds percent up to a maximum of 85 percent of the average weekly wage for the state
  • Death benefits
  • Hospital benefits
  • Burial expenses

VA Claims for Mesothelioma

Eligible Utah veterans with mesothelioma who were exposed to asbestos in the military may file a VA claim for monthly disability compensation and medical care. To qualify, you must prove each of the following:

How Much Time Do I Have to File a Mesothelioma Claim in Utah?

Utah imposes a time limit on filing mesothelioma lawsuits known as a statute of limitations. The time limit in Utah is three years after your diagnosis. 

If your family member had a claim but passed away before a lawsuit’s resolution, a personal representative may continue the case on their behalf. This is known as a survival action. The representative must bring the action within one year of the death or whenever the statute of limitations would have expired had the plaintiff lived, whichever is later.  Proceeds are generally awarded to the family.

If you are a family member of someone who died from mesothelioma, you may be able to file a wrongful death lawsuit to recover damages suffered by the family. A wrongful death suit must be filed within two years of the death.

Utah Industries with Asbestos Exposure

Asbestos was valued for its fire resistance, insulating properties, non-reactivity to chemicals, non-conductivity to electricity, tensile strength, flexibility, and light weight. It was often referred to as a miracle mineral because it provided so many functions in such a large number of applications.

Many of the major industries in Utah utilized high heat, such as foundries, mining operations, smelting companies, oil refineries, railroads, and energy companies. Asbestos was used as a safety measure to prevent fires and reduce damage in the event of an explosion.
The following industries in Utah relied heavily on asbestos in everyday operations:

In nearly every industry, asbestos was heavily used in building components and machinery parts. It strengthened industrial adhesives, provided thermal insulation in pipes and buildings, and prevented leaks in pipes that carried high-pressure and flammable materials. It was used in machine gaskets, engine turbines, boiler rooms, floor tiles, ceiling tiles, wallboard, and cement products.

Railroads in Utah

Utah is home to 1,704 miles of track of Class I railroad lines and 487 miles of short line. The Class I railroads in Utah include the BNSF Railway Company and Union Pacific Railroads. 

Asbestos was used in engine components on trains that generated friction, such as brakes and clutches. It was used in cement on railroad ties and in machinery and engine components. It insulated rail cars. Before asbestos was phased out, rail cars transported asbestos-containing products.

You May Have Been Exposed to Significant Levels of Asbestos in These Occupations

Workers in virtually every industry, even office workers, may have encountered asbestos. This is because asbestos was in numerous building components of most workplaces. However, the most significant sources of occupational asbestos exposure occurred when workers handled it directly, as occurred in the following occupations in Utah:

Operating Unit 16 in the northern part of Hill Air Force Base, located between Salt Lake City and Ogden, is currently an EPA Superfund Site. Asbestos was found at the site in the pipe insulation and roof shingles.

Utah Companies with a History of Exposing Workers to Asbestos

The largest percentage of asbestos exposure in Utah occurred in the areas surrounding Salt Lake City. Not surprisingly, this also corresponds to the area with the highest concentration of asbestos-related deaths per year. 

The Environmental Working Group has found that, based on 1999 to 2017 figures, an average of 29 people die from asbestos-related illnesses yearly in Salt Lake City County. This is significantly higher than second-place Utah County, with 11 asbestos-related deaths.
