Workers at oil refineries, military installations, and certain mineral processing facilities in North Dakota have likely been exposed to asbestos on the job and have a higher risk of developing mesothelioma, a rare and aggressive form of cancer tied to asbestos. From 1999 to 2020, 179 North Dakotans were diagnosed with mesothelioma.
In most states, the counties with the highest mesothelioma mortality rates are the same as those with the highest population. However, that’s not true in North Dakota. Mercer, McLean, Oliver, Morton, and Dunn counties have the highest rates of mesothelioma deaths in the Peace Garden state, with Morton County the lone representative from the state’s 10 most populated.

The waste products stored at the site contaminated nearby soil and groundwater, leading the EPA to add it to its Superfund National Priorities list. The site was removed from the list in 1997 after the completion of cleanup activities.
Occupations at Risk for Asbestos Exposure
Many industries used asbestos throughout most of the 20th Century for its inexpensiveness, strength, and heat-resistant properties. Fields with a higher risk of asbestos exposure in North Dakota include the following:
Turbines, generators, boilers, and other key power-generating equipment often included asbestos to protect from high temperatures. Workers at Coyote Station, Stanton Powerhouse, United Power, Northern States Power Company, Grand Forks Gas and Electric Company, and more may have encountered asbestos-containing components on the job.
Several North Dakota cities were home to facilities that processed vermiculite, a mineral used in construction and industry. Vermiculite mined in Libby, Montana, was notoriously contaminated with asbestos. Experts believe contaminated vermiculite from Libby made its way through North Dakota, potentially exposing workers to dangerous fibers.
North Dakota was home to numerous missile silos constructed during the Cold War. Some of these missile sites were found to have contained asbestos, potentially raising the risk of mesothelioma and similar illnesses among those who worked there.
Due to the high temperatures involved in oil production, many refineries used asbestos-containing materials such as insulation to protect key components. Mandan alone included multiple oil facilities where workers may have been exposed to asbestos, such as BP Amoco, Mandan Oil, and Standard Oil.
Asbestos was used in numerous applications on U.S. Military bases and could be found anywhere from brake pads and firefighting foam to the components of barracks. Those who have served, worked, or lived at facilities like Grand Forks Air Force Base and Minot Air Force Base may have inhaled asbestos fibers.

State law imposes some restrictions on a claimant’s ability to recover compensation for mesothelioma. Within 30 days of filing a lawsuit, a plaintiff must submit a sworn declaration saying they identified and filed any potential asbestos trust funds claims. Within 45 days, they must submit information detailing evidence that supports the naming of each defendant.
Companies are also shielded from liability when a third party adds asbestos to their products. In addition, When a company acquires an asbestos company, the purchaser’s asbestos liabilities are limited to the acquired company’s value.
