Texas Toxic Exposure Lawyer

Toxic exposures in the workplace can cause permanent health problems and disabilities that affect you and your entire family. Toxic chemicals are common in factories, chemical plants, construction sites, oil rigs, power plants, and agricultural sites. They lurk in products you may handle daily, such as detergents, pesticides, herbicides, solvents, and paint thinners. Industrial chemicals, especially when exposure happens as a result of plant and refinery work accidents, can cause immediate effects, such as chemical burns, damage to the eyes and eardrums, respiratory problems, mental confusion, and nausea.

Some substances cause harm over time without immediate warning signs. For example, exposure to lead can silently damage the brain or kidneys and cause birth defects. Our asbestos exposure and mesothelioma lawyers have represented hundreds of clients who developed deadly diseases decades after they were exposed to asbestos. They had no idea they were inhaling a harmful product.

Hazardous chemicals can hide in seemingly harmless products, such as wood preservatives and batteries, making it difficult to pinpoint the source of exposure. Our experienced Texas toxic exposure attorneys can investigate your work environment, identify the toxic exposure, and help you pursue compensation from those responsible. What Compensation Could You Get for Toxic Chemical Exposure in Texas?

If you are an injured employee, you likely qualify for workers’ compensation. Workers’ compensation provides medical care for work-related injuries and replaces some lost wages, regardless of fault. You generally cannot sue a covered employer. However, you may be able to file a third-party lawsuit against companies that contributed to the exposure, such as manufacturers, property owners, and contractors. You may be entitled to the following economic and non-economic damages:

  • Current and future medical expenses not covered by workers’ compensation
  • Lost wages
  • Loss of future earning capacity
  • Pain and suffering
  • Emotional distress
  • Loss of enjoyment of life
  • Scarring and disfigurement
  • Loss of bodily functions

If any third parties injured you while engaging in gross negligence or malicious conduct, you may also be entitled to punitive damages.

Compensation for Wrongful Death

When a loved one dies from a toxic exposure at work, surviving family members can generally collect some lost wages and funeral expenses from workers’ compensation. You may also be entitled to damages through a third-party wrongful death lawsuit. Wrongful death damages may include the following:

  • Loss of financial support
  • Loss of estate value
  • Funeral and burial expenses
  • Mental grief and suffering
  • Loss of companionship
  • Loss of parental guidance

If the employer contributed to the death through gross negligence, you may also be able to sue the employer for punitive damages, even if it carries workers’ compensation insurance.

In one of the cases we worked on, a worker tragically lost his life due to a gas release at a job site. When an alarm sounded, another worker rushed to help but also succumbed to the toxic fumes. The second worker left behind a wife and children. We pursued a lawsuit against the employer, proving gross negligence, and secured a substantial recovery for his family.

What Types of Lawsuits Can You Pursue When Exposed to Toxic Chemicals?

Multiple parties often contribute to toxic exposures. The nature of your exposure and who is responsible can determine which laws apply to your lawsuit. It is crucial to choose a toxic chemical exposure lawyer with experience handling your type of case. Your case may fall under one or more of the following:

  • Personal injury lawsuit – A legal action in which you must prove that someone else’s negligence caused you to suffer an injury
  • Wrongful death lawsuit – A legal action in which surviving family members must prove the death resulted from someone else’s negligence
  • Product liability lawsuit – A legal action against a manufacturer, distributor, or retailer who sold a defective product, in which you must prove the product had a manufacturing defect, design flaw, or inadequate warnings

How Long Do You Have to File a Claim For Toxic Exposure in Texas?

The Texas personal injury statute of limitations generally requires you to file your toxic exposure lawsuit within two years of the incident or your diagnosis. If your loved one dies because of a toxic exposure, you have two years from the date of their death to file a wrongful death lawsuit.

In cases involving asbestos or silicosis, you must file a physician’s report verifying your diagnosis and its cause. You then have two years from the date of death or the date you or your loved one served this report to the defendant, whichever is earlier.

In product liability cases, you generally must file suit within two years of the date of injury or when the victim reasonably should have discovered the injury. However, you have no more than 15 years from when the defendant sold the product to file suit.

Regardless of the time allowed, it is important to contact our knowledgeable Houston toxic chemical exposure attorneys as soon as possible to protect your claim. The most important evidence may only be available briefly, and you must have strong evidence to prove your case. Don’t wait—call The Lanier Law Firm at 800-723-3216 today for a free case evaluation.
