Texas Oilfield Accident Lawyer

Texas is the top oil-producing state in the United States, and many of the nation’s largest oil companies have their headquarters in the Lone Star State. Oil companies are massive corporations that focus primarily on profits, often at the cost of worker safety. Oilfield workers often work in confined spaces around flammable fuel products stored in high-pressure tanks. Many oilfield workers spend their days on platforms high above the ground, handling heavy equipment and working with high-voltage electricity.

The most common oilfield accidents include fires, explosions, falls, falling objects, and getting caught in or between machinery. These accidents can cause permanent paralysis, crushed bones, brain injuries, and death. A serious oilfield accident can cost you everything. We are dedicated to holding big oil companies accountable and helping injured oil workers and grieving families recover the compensation they deserve. Contact the Lanier Law Firm today to schedule your free case review.

Why Hire The Lanier Law Firm For Your Texas Oilfield Accident?

We have over 35 years of experience standing up to large companies and have recovered nearly $20 billion in compensation for injured accident victims. Mark Lanier started The Lanier Law Firm in 1990 with a vision to provide compassionate legal care and high-quality legal representation to those who need it.

Lawrence P. Wilson is one of our premier Houston oilfield injury lawyers. He went to high school with Mark Lanier and shares his passion for going after large corporations that injure others and refuse to compensate them. Oil companies are large, powerful corporations that often fail to invest in the health and safety of their workers.

We have successfully stood up to the largest corporations in the world and won significant compensation on behalf of injured individuals.

What Compensation Is Available for Oilfield Accident Victims in Texas?

Oilfield workers injured on the job may be eligible for workers’ compensation, which provides free medical care for occupational injuries and partial wage replacement benefits. You generally cannot sue your employer if you qualify for workers’ compensation insurance coverage. However, there are some exceptions, such as intentional conduct. Meanwhile, you can also file a personal injury lawsuit against any third parties that caused or contributed to your injuries, such as manufacturers of defective products and negligent contractors.

In a personal injury lawsuit, you may be able to recover economic, non-economic, and punitive damages. Economic damages compensate for the financial costs of your accident, while non-economic damages cover the less quantifiable impacts on your life. The economic and non-economic damages you might be entitled to recover in an oilfield injury lawsuit include the following:

  • Current medical expenses
  • Ongoing and future medical expenses
  • Lost wages
  • Lost future earning capacity
  • Pain and suffering
  • Mental anguish
  • Disfigurement
  • Impairment

A court may award punitive damages if you present clear and convincing evidence of fraud, malice, or willful and wanton conduct by the defendant.

Compensation for Fatal Oilfield Accident Injuries

If your loved one has died from an oilfield accident while working as an employee, workers’ compensation may provide death benefits. You may also be able to recover economic, non-economic, and punitive damages in a third-party wrongful death lawsuit against contractors, property owners, manufacturers, and others. Your economic and non-economic damages may include the following:

  • Funeral and burial expenses
  • Loss of your loved one’s probable lifetime income had they survived
  • Loss of inheritance
  • Your loved one’s medical expenses
  • Loss of companionship
  • Grief and mental suffering

If your loved one’s death occurred due to an employer’s gross negligence, you may also be able to sue them for punitive damages.Having a proven trial lawyer on your side who knows how to tell your story to a jury and establish the far-reaching effects of your injury is critical for recovering the maximum compensation available. Our award-winning firm is nationally recognized for our consistent results in court and settlement negotiations, which often stem from our willingness to think outside the box and use untraditional methods, such as props and technology, to communicate with juries.

Types of Oilfield Injury Cases We Handle

Our oilfield injury clients come to us with broken and crushed bones, head injuries, paralysis, amputations, burns, fatalities, and more. We can help regardless of the injury or its cause.

The Occupational Safety and Health Administration imposes safety regulations on the oil industry to prevent common oilfield accidents, which include the following:

Fires and Explosions

High-pressure storage tanks contain flammable liquids, which can explode.

Electrocutions

Defective equipment, exposed power lines, and inadequate lockout/tagout procedures cause high-voltage electrocutions.

Falls

Workers can fall from platforms high above the ground when they lack personal protective equipment or the surfaces are improperly maintained.

Strains and Sprains

Heavy lifting, pushing and pulling heavy loads, awkward body positions, and repetitive tasks injure workers.

Struck-By and Caught-Between Accidents

Workers may be caught in or struck by rotational machine parts, collapsed rigs, moving, falling, or faulty equipment and vehicles.

Toxic Exposures

Vapor leaks and fuel products in confined spaces put oil workers at risk of injury from inhalation or skin contact.

We are familiar with safety regulations and oilfields. We can identify violations and hold the culprits accountable.

FAQs About Oilfield Accident Cases

How Long Do I Have to File a Claim?

To pursue a lawsuit, according to the Texas statute of limitations, you generally must file suit within two years of the accident date or the death of a loved one.

However, this does not mean you should wait to contact one of our knowledgeable Texas oilfield work accident lawyers. The oil industry is big business, and oil companies fight claims. The evidence needed to support your claim may only be available briefly. The oil company’s insurance company will immediately investigate the accident while the best evidence is still available, and we will do the same thing. Involving us early gives you a level playing field and allows us to secure your compensation.

What Should I Do Immediately After an Oilfield Accident?

When you have been in an oilfield accident, the following immediate actions are necessary for the sake of your health and well-being and to protect your injury case:

  • Seek medical attention, even if you do not feel severely hurt.
  • Report the accident to your supervisor immediately.
  • Write down what happened and include as many details as you can remember, including safety conditions that may have contributed.
  • Take pictures of the scene.
  • Avoid posting about your case on social media.

Waiting too long to seek medical care gives the insurance company ammunition to say your injuries are not serious or that medical care is unnecessary. Even after the emergency has passed, completing medical treatment and promptly reporting symptoms are crucial. We can help you find a doctor and help you protect your case.
