Armstrong World Industries
Since 1948, the Armstrong World Industries site in Macon has produced ceiling tiles—a product that used to contain asbestos. The EPA added the site to its Superfund National Priorities List in 2011 after finding that waste disposal at nearby landfills contaminated groundwater, fish, and sediment. Cleanup operations have been underway in some capacity since and are continuing today.
LCP Chemicals Georgia
An oil refinery, power plant, and paint and chemical manufacturing plants are among the facilities that contributed to soil and groundwater contamination at the LCP Chemicals site in Georgia for much of the 20th century through 1994. The contamination is no longer considered a threat to public health, though mercury levels in nearby fish may make them unsafe for consumption.
Cedartown Industries, Inc.
The former Cedartown Industries foundry site made the National Priorities list in 1990 after the EPA found contamination from heavy metals, asbestos, and other materials. After a successful cleanup, regulators removed the site from the list in 2006, and it is considered safe today.

Personnel and Veterans in Georgia's Military Bases
Asbestos was used for fireproofing in barracks construction and many other products used on military bases, including Ft. Stewart, Hunter Air Force Base, Robins Air Force Base, and the U.S. Naval Hospital. Georgia has one of the largest veteran populations in the country, and many of those vets were exposed to asbestos during their service.
Papermill Workers in Georgia
In addition to asbestos in industrial equipment, some paper mill employees were exposed to asbestos added to paper products for heat resistance and sturdiness. Workers at Georgia-Pacific, Cedar Springs Paper Mill, Great Northern Paper Co., Interstate Paper Corp., and others may be at risk of asbestos-related illnesses.

Power plants generate a lot of heat to produce energy. Companies used asbestos to insulate pipes, gaskets, turbines, generators, and other key equipment from high temperatures. When we were contacted by clients for representation in an asbestos-related case whether it be lung cancer or mesothelioma, one of the considerations, in addition to establishing the liability, that is the responsible parties for the disease, we also have to evaluate the damages sustained by the client, the monetary damages.
So in lawsuits, in these kinds of lawsuits, particularly, we cannot make the mesothelioma go away. We cannot bring back the health of our client.
What we can do for our client is recover monetary damages to help with the strain, the financial strains that frequently go along with this type of diagnosis.
So in evaluating the damages, there are several factors that we look at. One is the pain and suffering and mental anguish that the person suffers as the disease progresses.
Mesothelioma is a horrible, horrific disease and it’s painful, and there is a lot of suffering that goes on to the final day. And so that is one of the elements of damage sustained by the client that we take into consideration.
Another element of damage would be that of the loved ones. So not only has the person who has the diagnosis suffered. The wife and the children of the client have also suffered and they are entitled to recover damages for wrongful death. So we evaluate the relationship between the client and their family members and evaluate the damages sustained by them.
Another factor that we look at in these cases is punitive damages.
These companies knew as early as 1942 that asbestos was carcinogenic and despite that knowledge, they continued to put this deadly toxic material out in the stream of commerce and subjected millions of Americans to exposure to a deadly toxin. They knew that, they knew it was carcinogenic and because it was a cheap product and they could make money doing it, they did it anyway.
So an element of damage that is seriously considered and a big part of every case is making those companies accountable for that conduct. You know, in criminal cases, accountability is jail time. In a civil case, we can’t put a company in jail. So in civil cases, accountability is money. And, that’s how we attempt to hold these companies responsible and accountable for this gross conduct of exposing millions of Americans to a deadly toxin.
Asbestos Laws and Regulations in Georgia
Georgia has a two-year statute of limitations for filing mesothelioma lawsuits, starting from the victim’s diagnosis or death. However, state law also restricts who can file a lawsuit and when. A 2016 Georgia Supreme Court ruling shielded asbestos manufacturers from liability for secondary exposure, also known as “take-home exposure,” severely limiting the extent to which they can be held accountable.
Additionally, Georgia only allows current residents or those exposed to asbestos in the Peach State to file mesothelioma lawsuits.
