How Long Do You Have To File a Mesothelioma Lawsuit in Indiana?

Prior to 2016, the Indiana statute of repose barred lawsuits against manufacturers of asbestos-containing products if the claim was brought more than 10 years after the delivery of the product to the consumer. In the landmark case of Myers v. Crouse-Hinds Div. of Cooper Industries, Inc., the Indiana Supreme Court struck down this law. 

A statute of limitations still exists, but now victims have to bring their claim two years from the date they are diagnosed with mesothelioma. It does not matter how long ago you were exposed, but you should file your claim within the two-year window from your diagnosis. If you do not, your claim will likely be dismissed regardless of whether it would have been successful.
