Asbestos Laws and Regulations in New Orleans

The old law required one to file a lawsuit within one year from the date of diagnosis or discovery of the illness. Now, the legal deadline is two years from the date of diagnosis or discovery of the illness. This change only applies to claims arising on or after July 1, 2024. For claims where the date of diagnosis or discovery was before July 1, 2024, the one-year prescription period still applies.

The one-year prescription period still also applies to wrongful death cases, which means a family member must file a wrongful death lawsuit within one year from the injured person’s death.
