We know what makes a great mesothelioma lawyer, and we’ve got what it takes.

Mark Lanier:

If you want to know who’s a great mesothelioma lawyer, you want to try and get the total package. You want to step into a law firm that’s got mesothelioma lawyers that, first of all, have the fierce dedication to look out for your interests, not to sign you up and send you to other lawyers.

You want someone that’s personally going to be involved, personally going to work with you, someone you can call on the phone and actually speak to them, knowing they know about your case.

So that personal involvement is one leg of the stool that’s gonna make for a great mesothelioma lawyer.

Second leg is experience. There are a lot of mesothelioma lawyers that may be really good at running an ad on TV or putting together this, that, or the other to sell themselves to potential clients, but you want one that’s got actual experience that’s going to leave no stone unturned.

Because here’s the key, your recovery in a mesothelioma case depends entirely upon which defendants produced a product that caused or contributed to your disease. And if there are 10 defendants, you may have 10 sources of money.

If there are 10 defendants, but your lawyer is only careful enough to get to 3 of them or only has enough experience to recognize 5 of them, you could be leaving a substantial amount of money on the table.

So leg number 1 on the stool is personal involvement, personal attention. Leg number 2 is experience. Leg number 3 is trial skill.

You want a lawyer that will try your case and get an incredibly just verdict for you, and this becomes extremely important because defendants will always try to pay you as soon as they’re afraid of what you might do to them in court.

And so you want that firm, you want that lawyer with that trial pedigree that shows a fierce willingness to go to court and to extract justice, but you get those three legs on the stool and you’ve got a good mesothelioma lawyer.

What Are the Asbestos and Mesothelioma Compensation Options in Delaware?

Those diagnosed with mesothelioma or another asbestos exposure-related illness in Delaware have multiple options for pursuing compensation, including mesothelioma lawsuits, asbestos trust fund claims, and VA claims.

Delaware Mesothelioma Lawsuits

Victims or their families can file a mesothelioma lawsuit against those responsible for their asbestos exposure and seek economic and non-economic damages for personal injury or wrongful death.

Asbestos Trust Funds Claims in Delaware

Victims of asbestos exposure in Delaware might also be eligible to file a claim with one or more asbestos trust funds. Many manufacturers of asbestos products have filed for bankruptcy protection to shield themselves from mounting liability to asbestos-exposure victims. The court required these bankrupt companies to establish these funds to compensate the victims.

VA Claims for Delaware Veterans Exposed to Asbestos

Military veterans exposed to asbestos during their service can pursue a claim with the Department of Veterans Affairs to receive monthly compensation and medical care benefits.

How Long Do You Have To File an Asbestos and Mesothelioma Claim in Delaware?

Delaware’s statute of limitations for filing a mesothelioma personal injury lawsuit is two years after a diagnosis. For wrongful death suits, claims must be filed within two years of the asbestos exposure victim’s death.

Our knowledgeable Delaware mesothelioma attorneys can help you prepare and file a timely claim, securing you the compensation and peace of mind you deserve.

E. I. DuPont de Nemours and Company

A Newport, Delaware, pigment plant formerly owned by chemical giant DuPont caused nearby groundwater and soil to be heavily contaminated. Workers dumped industrial waste containing heavy metals and asbestos into landfills at the site. The EPA selected the site for its Superfund Redevelopment Program in 1990 and finished its cleanup in 2002, though monitoring is still ongoing.

Because of its heat resistance, asbestos was heavily used in equipment and production lines at the plant. Therefore, workers were likely exposed to asbestos while working at the facility.

Dover Air Force Base

Since 1989, the Dover Air Force Base has been listed on the EPA’s Superfund National Priorities List for heavily contaminated groundwater, soil, and neighboring streams, including asbestos materials. Cleanup efforts continue to this day.

Meanwhile, the U.S. Air Force used asbestos extensively at its bases in housing structures, dining areas, and work facilities. Asbestos was also commonly used to fireproof brakes and other mechanical components. Thus, anyone who worked or served at Dover Air Force Base was likely exposed to the material.

What Occupations Are at Risk for Asbestos Exposure in Delaware?

Jobs in manufacturing, industrial, or military fields are often at the highest risk for asbestos exposure. High-risk asbestos exposure occupations in Delaware include the following:

Delaware Chemical Plant Workers

Delaware is home to many chemical plants, including those owned by DuPont, Allied Chemical, and General Chemical. Asbestos was widely used in chemical production because of its heat-resistant properties, exposing employees who worked with or near items like furnaces and turbines.

Power Plant Workers in Delaware

Facilities like the Yankee Nuclear Power Plant and Central Maine Power Plant used asbestos-containing materials in turbines, generators, and other equipment that generated heat. Employees who worked on such equipment may have inhaled asbestos fibers dislodged during installation or maintenance.

Manufacturing Workers in Delaware

Phoenix Steel, Ludlow Mills, Graver Tank, and others operated plants in the First State that exposed workers to asbestos. Boiler components and other materials, such as insulation, released asbestos fibers into the workplace.

Delaware Construction Workers

Asbestos products were heavily used in construction projects throughout the state. Common construction components like floor tiles and cement release asbestos fibers when ground, cut, or sanded.

If you are a construction worker diagnosed with mesothelioma, our Asbestos Senior Litigation Counsel, Sam E. Taylor, explains how you could have been exposed to asbestos in construction.

Oil Workers in Delaware

Sun Oil, Getty Oil, and others operated refineries in Delaware that used asbestos-containing materials. Oil workers who installed, maintained, repaired, or worked near equipment designed to withstand high temperatures might have been at the highest risk of exposure.

Delaware Military Staff

Though the project began in 1989, Dover Air Force Base is still undergoing cleanup efforts related to asbestos exposure on the site. Asbestos was commonly used in many military capacities, including fireproofing materials, and anyone living or on the base could have been exposed.
