What Are the Options for Mesothelioma Financial Compensation in Rhode Island?

Victims of asbestos exposure in Rhode Island have several options for mesothelioma financial compensation, including filing a mesothelioma lawsuit, accessing asbestos trust funds, seeking veterans’ benefits, or applying for workers’ compensation benefits. Our talented Rhode Island mesothelioma attorneys will evaluate your case and determine if you qualify for one or more of the financial recovery options below.

Rhode Island Mesothelioma Lawsuit

Filing a mesothelioma lawsuit in Rhode Island is the most common method for asbestos exposure victims to seek financial compensation. Lawsuits can be filed against former employers, asbestos manufacturers, or other responsible parties. These lawsuits are usually personal injury or mesothelioma wrongful death claims.

Asbestos Trust Fund Claims Against Bankrupt Rhode Island Companies

Some Rhode Island companies, such as Owens Corning and Johns-Manville Corporation, have filed for bankruptcy due to mesothelioma liability and established asbestos trust funds to compensate claimants. These funds are designed to help victims receive compensation when the company itself cannot be sued directly.

Rhode Island Veterans’ Benefits

Military veterans who were exposed to asbestos during their service have the option to pursue additional compensation through a claim with the VA.

Workers’ Compensation in Rhode Island

Individuals exposed to asbestos while on the job may also be entitled to mesothelioma workers’ compensation benefits, providing another avenue for financial recovery.

What Is the Time Limit To File a Rhode Island Mesothelioma Claim?

Under the state’s time limit or statute of limitations for mesothelioma claims, personal injury lawsuits must be filed within three years of a diagnosis. For wrongful death claims, the suit must be filed within three years of the victim’s passing. Our dedicated Rhode Island mesothelioma attorneys can help you file a timely claim and secure the compensation you deserve.

Naval Station Newport

Formerly known as the Newport Naval Education/Training Center, Naval Station Newport was used as a training base and refueling depot for most of the 20th century and became home to the Naval War College. The base was added to the EPA’s Superfund National Priorities List in 1989 due to its history of contamination with hazardous materials, including asbestos. Site monitoring continues to this day.

Stamina Mills

The Stamina Mills site in North Smithfield was a textile mill that operated from the early 1800s through 1975. The EPA began cleanup efforts at the site in the 1990s after finding it was contaminated with chemicals. Buildings on the property also were found to contain asbestos. The site is still under EPA supervision.

What Occupations Are at Risk for Asbestos Exposure in Rhode Island?

Some examples of Rhode Island occupations at risk of asbestos exposure include:

Personnel in Rhode Island School Buildings Built Before the 1980s

Many Rhode Island schools built before the 1980s contained asbestos in construction materials like insulation, ceiling tiles, and floor tiles, potentially exposing students, staff, and teachers if disturbed. Buildings confirmed to have contained asbestos include Ashton Elementary School, McCourt Middle School, and North Cumberland Middle School.

Veterans and Personnel in Rhode Island's Military Bases

Naval Station Newport and other Rhode Island military bases contained asbestos, as the U.S. Armed Forces used the mineral for many functions. Those living, working, or serving on these bases may have been exposed to asbestos particles in the air.

Rhode Island Manufacturing Workers

Rhode Island’s manufacturing industry used asbestos in its machinery, equipment, and building materials due to its durability and heat resistance. Workers in Providence may have been exposed to asbestos while producing boilers, water heaters, textiles, and other products—especially if they operated or maintained asbestos-containing equipment.

Learn more about asbestos exposure in plant workers, including manufacturing plants, from our attorneys Sam E. Taylor and Abigail Harris.

Shipyard Workers in Rhode Island

Rhode Island’s coastline made it a natural home for the shipbuilding industry, which heavily used asbestos in constructing vessels. Shipyard workers under employers like Walsh-Kaiser Company Inc. may have also exposed others to asbestos fibers stuck to their clothing.

What Asbestos Regulations and Safety Standards Help Protect Rhode Island Workers?

The Rhode Island Department of Environmental Management sets safety standards for handling asbestos, including regulations for worker safety, licensing requirements for abatement contractors, and more. Those who violate these standards can be held liable.
