What Are the Compensation Options for Mesothelioma in Vermont?

There are multiple compensation options available for mesothelioma victims in Vermont, including mesothelioma lawsuits, asbestos trust fund claims, workers’ compensation, and VA claims for Vermont veterans.

What Is a Vermont Mesothelioma Lawsuit?

Mesothelioma lawsuits are legal actions that seek to provide mesothelioma victims and their families with financial compensation for their asbestos exposure in Vermont. These types of mesothelioma claims fall into two categories: personal injury lawsuits and wrongful death lawsuits.

Personal Injury Lawsuits for Mesothelioma in Vermont

A Vermont personal injury lawsuit can be filed against the manufacturers, distributors, and retailers of the asbestos-containing products you were exposed to and would allow you to receive significant compensation for your medical bills, lost wages, pain, suffering, and more.

Mesothelioma Wrongful Death Lawsuits in Vermont

Family members and loved ones of deceased asbestos-exposure victims can file a wrongful death lawsuit, among other asbestos claims after death, to recover compensation for funeral costs, pain and suffering of the deceased, loss of companionship, lost income, and other financial and emotional losses.

What Is a Vermont Asbestos Trust Fund?

Asbestos trust funds are money that was set aside for asbestos exposure victims after the responsible Vermont companies declared bankruptcy. Seeking compensation through these funds is often quicker and simpler than pursuing a lawsuit. Zonolite Attic Insulation is a Vermont company that has established an asbestos trust.

What Are Workers’ Compensation Claims for Mesothelioma in Vermont?

Workers’ compensation claims for mesothelioma allow Vermont workers to recover compensation benefits, including partial wage replacement, coverage for mesothelioma treatment, and death benefits for surviving family members of mesothelioma victims who passed away.

What Are Mesothelioma VA Claims for Vermont Veterans?

VA claims allow Vermont veterans to receive monthly tax-free mesothelioma benefits and no-cost health care through the Department of Veterans Affairs.

Find out more about the specifics of VA benefits claims from The Lanier Law Firm’s attorney, Abigail Harris.

What Is the Statute of Limitations for Mesothelioma Claims in Vermont?

Vermont has a three-year statute of limitations for personal injury claims, starting at the date of a mesothelioma diagnosis. However, the state has a separate deadline for wrongful death claims, requiring claimants to file within two years of a victim’s passing. Our Vermont mesothelioma attorneys can help you file a timely claim and avoid any stress over deadlines.

Belvedere Mountain

Vermont became a prominent hub for asbestos mining thanks to natural deposits like those found on Belvedere Mountain, where the first commercial mine opened in the state. The Belvedere Mountain mine continued to operate for years after the dangers of asbestos became public knowledge, finally closing in 1993.

After the mine’s closure, the site contained roughly 30 million tons of asbestos waste. Vermont Asbestos Group, the most recent operator of the mine, agreed to a settlement in 2013 in which it would provide $30 million to assist with cleanup costs.

What Occupations Are at Risk for Asbestos Exposure in Vermont?

Most asbestos exposure in Vermont occurred among workers in certain fields who regularly used the mineral in a multitude of applications. The professions most at risk include the following:

Vermont Miners

Asbestos mines in Vermont operated from 1823 to as late as 1993. Mining equipment regularly shattered and dislodged asbestos fibers, sending them into the air and causing workers to inhale them.

Power Plant Workers in Vermont

Power plants often used asbestos to insulate key components like turbines, boilers, and generators from high temperatures. Employees at Vermont Electric Power Company Inc., Montpelier and Barre Light and Power Company, and others might have been exposed if they worked with or near asbestos-containing equipment.

Vermont School Personnel

The University of Vermont in Burlington has found asbestos-containing materials on its campus. Teachers, staff, and students in older school buildings might be exposed to asbestos when forgotten or overlooked components containing the material become damaged and release fibers into the air.

Vermont Paper Mill Workers

Many Vermont paper mills made use of asbestos in their production processes, potentially putting workers throughout the facility at risk of developing mesothelioma.

Asbestos Regulations in Vermont

Vermont has regulations requiring the removal of any asbestos from buildings before any renovations or demolitions. The law also only allows certified contractors to conduct asbestos removal.

Many homes and schools built before the 1980s used asbestos-containing materials, potentially serving as a health risk to occupants or renovators.

Between 1999 and 2020, 150 Vermonters were diagnosed with mesothelioma, and 124 died from the disease, according to the Centers for Disease Control and Prevention. If you have been diagnosed with an asbestos-related illness, the dedicated Vermont mesothelioma attorneys with The Lanier Law Firm can help.
